This session will explore how doctrines of first sale and fair use can be used by libraries to scan their books and lend them out on terms that are economically analogous to physical lending using “controlled digital lending.” It will address the legal theory, relevant cases such as Capitol Records v. Redigi, and how to translate those theories into practical strategies to open up library collections.
