Section 109, which codifies the common law doctrine of exhaustion, called “first sale” in the United States, is the foundation of library practice. Without it, our daily work would look very different than it does. Yet as we move into the digital environment, it is not at all clear whether and in what form First Sale will move with us. Come and discuss the various alternatives -- and licensing is a vital part of that discussion -- and the current thinking about first sale and the potential impact those options have on libraries.
