Section 110(1) of the Copyright Act is often referred to as the "Classroom Exemption" and generally allows for the public showing of films in "place[s] devoted to instruction," provided certain conditions are met. Does this exemption apply to libraries? And if so, what are reasonable parameters libraries should follow to ensure film showings don't infringe movie studios' public performance rights? With the ever growing popularity of library film series, as well as educational considerations of using film for instructional purposes, an understanding of this exemption is critical. This breakout will explore reliance on this important exemption for libraries.
