At the launch of MIT OpenCourseWare (OCW) in 2002, Creative Commons was in its infancy. What everyone at MIT agreed, however, was that we wanted users to reuse, remix and share OCW content. Since OCW is an open access site (and had conservative IP Counsel at the time), fair use did not seem possible for us. It took us a full seven years to understand and eventually apply it, resulting in the Code for Best Practices in Fair Use for OpenCourseWare (2009). This session will discuss how MIT OpenCourseWare realized the full potential of fair use to enrich its publication.
